Terms of Service

This document sets out the agreements that govern your use of the Kidlinka Platform. It incorporates the Provider Agreement, Refund & Cancellation Policy, License Verification Policy, and Community Guidelines below.

Terms of Service

Introduction

Welcome to Kidlinka LLC. We operate a technology platform that connects parents and guardians with licensed childcare providers — including licensed childcare centers and licensed family home providers. We also offer marketing, enrollment, communication, lead management, workforce management, emergency childcare request services, and related software tools.

These Terms of Service govern your access to and use of the Kidlinka website, mobile applications, software, products, services, and related features (the "Platform"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.

Eligibility

To use the Platform, you must:

  • Be at least eighteen (18) years old
  • Have legal authority to enter into binding agreements
  • Provide accurate and complete information
  • Comply with all applicable laws, regulations, licensing requirements, and Platform policies

Kidlinka may refuse service, suspend accounts, or terminate access if a user fails to meet these requirements.

Description of Services

The Platform may include childcare provider search and discovery; parent-provider communication tools; enrollment inquiry management; emergency childcare request services; provider verification; reviews and ratings; lead generation and marketing automation; AI-assisted flyer generation; landing page creation; social media publishing; CRM tools; employee scheduling and workforce management; and subscription-based software services. Kidlinka reserves the right to modify, add, suspend, or discontinue any feature at any time.

Kidlinka Is Not a Childcare Provider

Kidlinka is a technology company and marketplace platform. We do not provide childcare services, employ childcare providers, operate childcare facilities, supervise childcare activities, or guarantee provider performance or childcare outcomes. All childcare services are provided solely by independent providers, and all agreements regarding childcare are between the parent and the provider.

Provider Verification

Providers seeking a Verified Provider badge must submit required documentation, including a childcare license, government-issued identification, CPR and First Aid certification, insurance documentation, and any additional materials requested by Kidlinka. A badge indicates only that Kidlinka reviewed certain documents — it does not mean Kidlinka conducted background checks, home inspections, or safety inspections, or that Kidlinka endorses the provider. Parents remain responsible for evaluating providers independently.

Emergency Childcare Requests

Parents may submit emergency requests through the Platform. Requests are distributed to nearby eligible providers; the first provider to accept may receive the booking. Kidlinka does not guarantee provider acceptance. If no provider accepts within forty (40) minutes, Kidlinka may issue a full refund per the Refund Policy.

Payments

Kidlinka may collect payments from parents on behalf of providers and deduct marketplace fees, emergency request fees, Platform fees, subscription fees, processing fees, and other disclosed fees before issuing payouts. Funds may be delayed, withheld, or adjusted in cases involving fraud, disputes, chargebacks, compliance reviews, or legal obligations.

Subscription Plans & Billing

Kidlinka offers subscription-based services for providers under plans such as Starter, Growth, Pro, and others introduced over time. Subscription fees are disclosed before purchase and automatically renew unless canceled before the next billing cycle. Except where required by law, subscription fees are non-refundable once a billing period has begun. Kidlinka reserves the right to modify pricing, features, or benefits upon reasonable notice.

Provider Payouts

Providers may receive payouts on a recurring schedule established by Kidlinka. Instant payout options may be available, subject to additional fees and eligibility requirements. Funds may be delayed, withheld, or reversed in connection with fraud, disputes, chargebacks, or violations of Platform policies.

Reviews & Ratings

Parents may submit reviews and ratings. Providers may respond publicly and may request investigations of reviews they believe are fraudulent, misleading, or policy-violating. Kidlinka reserves the right to investigate, remove, edit, restrict, or retain reviews at its sole discretion.

Account Suspension & Termination

Kidlinka may suspend, restrict, or terminate any account for reasons including fraud, false information, fake reviews or licenses, identity fraud, harassment, threatening behavior, child safety concerns, chargeback abuse, or violations of applicable law or Community Guidelines — with or without prior notice.

Intellectual Property

The Platform, software, trademarks, logos, branding, designs, and related intellectual property are owned by Kidlinka LLC or its licensors. Users may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works without written permission from Kidlinka.

User Content License

Users retain ownership of content they submit. By uploading content, users grant Kidlinka a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, modify, publish, and use such content to operate, improve, market, and provide Platform services.

Limitation of Liability

To the fullest extent permitted by law, Kidlinka shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of the Platform or services provided by independent providers — including childcare outcomes, provider or parent conduct, injuries, losses, business interruptions, or lost profits.

Indemnification

Users agree to defend, indemnify, and hold harmless Kidlinka LLC, its owners, officers, employees, affiliates, contractors, and agents from claims, liabilities, damages, losses, expenses, and costs arising from their conduct, services, content, violations of law, or breach of these Terms.

Arbitration, Dispute Resolution & Class Action Waiver

Before initiating legal proceedings, users agree to attempt good-faith informal resolution by contacting legal@kidlinka.com. Unresolved disputes shall be resolved through binding arbitration (except where prohibited by law). Users waive any right to participate in class actions, class arbitrations, or representative proceedings against Kidlinka.

Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Additional Provisions

Electronic signatures and consents have the same legal effect as handwritten signatures. Users consent to receive communications from Kidlinka, including emails, SMS, and notifications, and may opt out of certain communications where permitted by law. Kidlinka is not liable for delays caused by events beyond its reasonable control (force majeure). Kidlinka may assign its rights and obligations in connection with a merger, acquisition, or restructuring. If any provision of these Terms is found invalid, the remaining provisions remain in effect.

Changes to These Terms

Kidlinka may update these Terms from time to time. Continued use of the Platform after updates become effective constitutes acceptance of the revised Terms.

Provider Agreement

Introduction

This Provider Agreement governs the participation of childcare providers on the Kidlinka LLC platform. Kidlinka operates a technology platform that helps connect parents and guardians with licensed childcare providers. By creating a provider account, submitting information, uploading verification documents, subscribing to a provider plan, or using provider services, you agree to this Agreement.

Provider Eligibility

To participate as a provider on Kidlinka, you must:

  • Be at least eighteen (18) years old
  • Operate or represent a licensed childcare business
  • Provide accurate and complete business information
  • Maintain all licenses, certifications, insurance, and approvals required by law
  • Comply with all applicable federal, state, and local laws
  • Agree to Kidlinka's Terms of Service, Privacy Policy, Refund & Cancellation Policy, License Verification Policy, and Community Guidelines

Kidlinka may approve, deny, suspend, or remove provider accounts at its discretion.

Verification Requirements & Verified Provider Badge

Providers must submit required verification documents, including a childcare license, government-issued identification, CPR and First Aid certifications, insurance documentation, and any additional materials requested by Kidlinka. A Verified Provider badge means only that Kidlinka reviewed certain submitted documents — it does not mean Kidlinka conducted background checks, home or safety inspections, or that Kidlinka endorses or guarantees the provider. Kidlinka may remove a badge at any time if documents expire, become invalid, or if safety, compliance, fraud, or policy concerns arise.

Provider Minimum Standards

Providers agree to maintain all required childcare licenses, insurance coverage, and CPR and First Aid certifications; comply with all applicable laws; provide truthful and accurate information; treat parents, children, staff, and users respectfully; and maintain safe and appropriate childcare environments. Failure to meet these standards may result in account restrictions, removal of verification status, suspension, or termination.

Independent Business Status

Providers are independent businesses, not employees, agents, partners, joint venturers, franchisees, or representatives of Kidlinka. Kidlinka does not control, supervise, manage, operate, inspect, or direct provider childcare services. Providers are solely responsible for their childcare operations, employees, facilities, safety practices, policies, and legal compliance.

Provider Responsibilities

Providers are solely responsible for child supervision and safety; staff supervision and training; licensing compliance; health, safety, and emergency preparedness; recordkeeping; parent communications; medication and transportation policies; regulatory compliance; insurance coverage; enrollment and tour decisions; emergency childcare acceptance decisions; and incident reporting.

Staff Responsibility

Providers are solely responsible for all employees, assistants, volunteers, contractors, and other individuals working within their childcare program — including hiring decisions, background checks, employee screening, training, payroll, tax compliance, employment law compliance, licensing requirements, workplace policies, and staff recordkeeping. Kidlinka does not employ, supervise, train, direct, manage, or control provider personnel.

Accuracy of Information

Providers must maintain accurate, complete, and current information on the Platform, including business name, owner information, address, contact details, license and insurance information, CPR and First Aid certifications, operating hours, capacity, age groups, pricing, staff information, and availability. Failure to maintain accurate information may result in removal of verification status, account restrictions, suspension, or termination.

License, Insurance & Certification Maintenance

Providers must immediately notify Kidlinka if any license, certification, insurance policy, approval, or legal authorization is suspended, revoked, restricted, expired, placed on probation, under investigation, or otherwise no longer valid. Kidlinka may remove verification status, pause listings, suspend bookings or emergency childcare participation, remove from search results, or terminate the account.

Subscriptions & Enrollment Leads

Providers must select a subscription plan (such as Starter, Growth, or Pro) to access provider services. Subscription fees are non-refundable once a billing period begins, unless required by law. Kidlinka may modify plan names, pricing, features, or benefits upon reasonable notice.

Providers may not intentionally redirect, solicit, or complete Platform-generated enrollment transactions outside of Kidlinka to avoid Platform fees. Violations may result in account suspension or removal, fee recovery, access restrictions, or other permitted action.

Emergency Childcare Participation & Cancellations

Providers may participate in emergency childcare request services if eligible. Providers may review request details before accepting and should only accept requests they are licensed, qualified, available, and able to fulfill. Providers may cancel within ten (10) minutes of acceptance. After that grace period, cancellations may be recorded and reviewed. Repeated cancellations may result in warnings, temporary suspension, removal of emergency childcare privileges, account restrictions, or termination.

Parent Identity Check & False Information

For emergency childcare bookings, providers may require government-issued identification from the parent or authorized guardian at drop-off or pick-up. If information does not match, the provider may refuse care, cancel the booking, and notify Kidlinka. If a provider determines that parent, child, or booking information is materially inaccurate and proceeding would create safety, licensing, or compliance concerns, the provider should not proceed and should notify Kidlinka.

Provider Payouts & Payment Disputes

Kidlinka may collect payments from parents and issue payouts to providers after deducting applicable Platform fees, marketplace fees, processing fees, subscription fees, chargebacks, refunds, and other amounts owed. Kidlinka may offer weekly payouts and instant cash-out options subject to fees, eligibility, and payment processor limitations.

In connection with payment disputes or chargebacks, Kidlinka may withhold or deduct from future payouts, request supporting documentation, suspend payouts during investigations, reverse transactions where permitted, and cooperate with payment processors. Providers agree to cooperate with dispute investigations; failure to do so may result in account restrictions or termination.

Taxes

Providers are solely responsible for determining, reporting, collecting, and paying all taxes, fees, assessments, and governmental charges related to their services, income, employees, and business operations. Kidlinka is not responsible for provider tax obligations, though Kidlinka may issue tax forms or collect tax-related information if required by law or payment processors.

Reviews, Investigations & Complaints

Parents may submit reviews and ratings. Providers may publicly respond and may request investigation of reviews they believe are false, fraudulent, misleading, abusive, harassing, spam, retaliatory, or policy-violating. Kidlinka may investigate, remove, retain, restrict, or modify reviews at its sole discretion. Kidlinka is not required to remove reviews simply because a provider disagrees with them.

Providers agree to cooperate with Kidlinka investigations relating to complaints, safety concerns, fraud, policy violations, licensing issues, payment disputes, or other matters — including providing licensing records, communications, booking records, staff records, and other reasonably requested information. Failure to cooperate may result in restrictions, suspension, payout holds, or termination.

Marketing Tools & Social Media Authorization

Kidlinka may provide providers with AI-assisted flyers, landing pages, lead capture forms, CRM tools, email automation, social media scheduling, and other promotional tools. Providers are responsible for reviewing and approving marketing content before use or publication. Kidlinka does not guarantee leads, enrollment, revenue, occupancy, social media engagement, or business growth.

Providers may connect social media accounts and authorize Kidlinka to publish approved content to those accounts. Kidlinka is not responsible for third-party social media platform rules, restrictions, outages, account suspensions, or content moderation decisions.

Provider Content License

Providers retain ownership of content they upload to Kidlinka. By uploading content, providers grant Kidlinka a worldwide, non-exclusive, royalty-free license to display, include, use, and publish that content in connection with Platform operations, provider profiles, search results, marketing, and provider-requested marketing materials. Providers represent that they have all required rights, permissions, and consents to upload and authorize use of such content.

Child Photos & Consent

Providers may upload photos or videos containing children only if they have obtained all required parental or legal guardian consent. Providers are solely responsible for maintaining consent records. Kidlinka may request proof of consent if a complaint is received and may remove photos or videos that appear to violate privacy rights, consent requirements, or Platform policies.

Staff Management Tools

Kidlinka may provide staff management, employee scheduling, attendance tracking, and workforce tools. Providers remain solely responsible for compliance with all labor, employment, wage, hour, payroll, tax, scheduling, licensing, and workplace laws. Kidlinka does not provide legal, payroll, tax, HR, or employment advice.

Prohibited Provider Conduct

Providers may not submit false information, upload fake documents, misrepresent license status or capacity, harass parents or users, discriminate unlawfully, circumvent Platform fees, submit fake reviews, abuse emergency childcare systems, use parent information for unrelated purposes, violate child privacy rights, or violate Platform policies or applicable laws.

Account Restrictions & Termination

Kidlinka may restrict, suspend, or terminate provider accounts for policy violations, false information, fake documents, expired licenses or insurance, safety or regulatory concerns, repeated emergency cancellations, chargeback abuse, failure to cooperate with investigations, circumvention of Platform fees, parent complaints, or violations of law. Kidlinka may act with or without prior notice where necessary to protect users, children, parents, providers, or the Platform.

Limitation of Liability & Indemnification

To the fullest extent permitted by law, Kidlinka shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages. Kidlinka is not responsible for provider operations, childcare services, parent or child conduct, injuries, licensing issues, staff conduct, employment matters, business losses, or disputes between parents and providers.

Providers agree to defend, indemnify, and hold harmless Kidlinka LLC, its owners, officers, employees, contractors, affiliates, agents, and partners from claims, liabilities, damages, losses, expenses, and costs arising from provider childcare services, business operations, employees or staff, content, violations of law, breach of this Agreement, or claims by parents, children, employees, agencies, or third parties.

Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Washington. Before initiating formal legal proceedings, providers agree to contact Kidlinka at legal@kidlinka.com and attempt informal resolution. Unresolved disputes may be resolved according to the dispute resolution procedures in Kidlinka's Terms of Service.

Changes to This Agreement

Kidlinka may update this Agreement from time to time. Material changes may be communicated through the Platform or email. Continued use of provider services after updated terms become effective constitutes acceptance of the revised Agreement.

Refund & Cancellation Policy

Introduction

This Refund & Cancellation Policy explains how refunds, cancellations, no-shows, payment disputes, and related issues are handled on the Kidlinka LLC platform. By using Kidlinka, submitting a childcare request, accepting a request, purchasing a subscription, or making a payment, you agree to this Policy.

This Policy should be read together with Kidlinka's Terms of Service, Privacy Policy, Provider Agreement, License Verification Policy, and Community Guidelines. Where a conflict exists between this Policy and another Kidlinka policy, Kidlinka may determine which applies at its sole discretion, unless prohibited by law.

Emergency Childcare Requests

Parents may submit emergency childcare requests through Kidlinka. Requests are distributed to nearby eligible providers, and the first provider to accept may receive the booking. Parents may be required to pay the estimated childcare amount, Platform fees, emergency request fees, processing fees, and other disclosed charges before a request is sent to providers. Kidlinka does not guarantee that any provider will accept an emergency childcare request.

No Provider Accepts Within 40 Minutes

If no provider accepts an emergency request within forty (40) minutes of submission, Kidlinka will generally issue a full refund to the parent. Kidlinka may delay, adjust, withhold, or deny refunds in cases involving fraud, abuse, false information, payment disputes, chargebacks, duplicate requests, policy violations, suspicious activity, or other circumstances reasonably determined by Kidlinka.

Parent Cancellation After Provider Acceptance

If a parent cancels after a provider accepts an emergency childcare request, Kidlinka may issue a partial refund, full refund, or no refund depending on circumstances. Kidlinka may allow the provider to receive a cancellation fee or partial compensation. Factors considered include how quickly the parent canceled, whether the provider had prepared for care or turned away other opportunities, whether information was accurate, whether fraud is suspected, and the nature of any emergency.

Parent No-Show

If a provider accepts a request and the parent does not arrive, does not deliver the child, abandons the request, or fails to communicate within a reasonable time, Kidlinka may treat the request as a no-show. In this case, the parent may not receive a full refund, the provider may receive a partial no-show fee, Kidlinka may retain applicable Platform fees, and Kidlinka may investigate the matter. Repeated no-shows may result in account restrictions, suspension, or termination.

Provider Cancellation After Acceptance

If a provider cancels an accepted emergency childcare request, Kidlinka will generally issue a full refund to the parent if no replacement is found. Kidlinka may also attempt to resend the request to other nearby providers. Goodwill compensation, promotional credits, or account credits may be offered to the parent at Kidlinka's sole discretion and are not guaranteed.

Providers may cancel within ten (10) minutes of accepting a request (the grace period). After the grace period, cancellations may be recorded and reviewed. Repeated cancellations may result in warnings, temporary suspension from emergency childcare participation, removal of emergency childcare privileges, account restrictions, account suspension, or account termination.

Re-Matching After Provider Cancellation

If a provider cancels an accepted request, Kidlinka may attempt to send the request to other nearby eligible providers. Kidlinka does not guarantee a replacement will be found. If no replacement is found, refund eligibility is determined under this Policy.

Early Pick-Up

If childcare services begin and a parent picks up the child before the scheduled end time, no refund will generally be provided for unused time. Providers reserve space, staffing, scheduling, and resources based on the original booking. Once childcare services have started, booked time is considered earned and non-refundable unless otherwise required by law or approved by Kidlinka.

Refusal of Care Due to Safety or Information Concerns

A provider may refuse care if parent or child information is false, misleading, or withheld; if identification does not match booking information; if the provider is not licensed or authorized based on age, capacity, or program restrictions; if safety concerns exist; if the child's needs were not accurately disclosed; or if other material concerns are identified. In these situations, Kidlinka may investigate and determine whether a full refund, partial refund, provider compensation, or account action is appropriate.

False or Misleading Information

Parents are responsible for submitting truthful, complete, and accurate information. If a parent submits false or misleading information, Kidlinka may deny or limit a refund, compensate the provider, suspend or terminate the parent account, report fraud or safety concerns where appropriate, or take other action permitted by law and Platform policies.

Provider Payments, Payouts & Payout Holds

Providers become eligible to receive payment after childcare services are completed, subject to Kidlinka's payout procedures and applicable deductions for Platform fees, chargebacks, refunds, and other amounts owed. Kidlinka may offer recurring payouts (such as weekly) and instant cash-out options subject to fees, eligibility, and payment processor limitations. Instant cash-out fees are generally non-refundable once processed.

Kidlinka may delay, hold, reduce, reverse, or withhold provider payouts in cases involving refund requests, payment disputes, chargebacks, fraud or safety investigations, licensing concerns, policy violations, parent complaints, regulatory issues, incorrect payout information, or other circumstances reasonably determined by Kidlinka.

Subscription Fees

Provider subscription fees are generally non-refundable once a billing cycle begins. Providers may cancel subscriptions through the Platform; cancellation generally takes effect at the end of the current billing cycle. Kidlinka does not guarantee refunds for unused subscription time, partial billing periods, downgraded plans, or unused features unless required by law.

Providers may upgrade or downgrade subscriptions through Platform settings. Plan changes may affect available features, billing amounts, renewal dates, and access to services. Kidlinka may apply prorated charges, credits, or adjustments at its discretion. Failed subscription payments may result in payment retries, notifications, suspension of subscription features, profile pause, removal of access to marketing tools, booking restrictions, subscription termination, or other action.

Platform & Payment Processor Fees

Kidlinka may charge Platform fees, marketplace fees, emergency request fees, subscription fees, processing fees, instant payout fees, and other disclosed fees. Fees may be deducted before provider payouts are issued and may be non-refundable unless required by law. Payments may be processed by third-party processors, and Kidlinka is not responsible for delays, errors, holds, declines, chargebacks, or processing decisions made by those processors.

Chargebacks, Payment Disputes & Abuse

If a parent initiates a chargeback or payment dispute, Kidlinka may investigate the matter, recover amounts owed, suspend the parent account, restrict future services, withhold or deduct from provider payouts, request supporting documentation, cooperate with payment processors, deny future refund requests, or take other permitted action.

Chargeback abuse — including disputing valid charges after receiving childcare services, making false claims, repeatedly filing disputes, or using chargebacks to avoid Platform fees — is prohibited. Kidlinka may suspend or terminate accounts involved in chargeback abuse.

Goodwill Credits & Refund Timing

Kidlinka may, at its sole discretion, provide goodwill credits, promotional credits, account credits, or discounts. These are not guaranteed and may be limited, modified, revoked, or expire per terms set by Kidlinka.

Approved refunds may take time to process, depending on payment processor timelines, bank processing times, fraud or dispute review, chargeback status, regulatory issues, or other factors outside Kidlinka's control. Refunds are generally issued to the original payment method where possible.

Policy Abuse & Case-by-Case Review

Users may not abuse the refund or cancellation system. Abuse may include repeated cancellations, repeated no-shows, false emergency requests, fake payment disputes, duplicate requests, misleading information, circumventing Platform fees, or harassing Kidlinka staff about refund outcomes. Policy abuse may result in account restrictions, suspension, termination, refund denial, or other action.

Kidlinka may review refund and cancellation issues on a case-by-case basis, considering the conduct of both parties, timing, accuracy of information, safety and licensing concerns, provider preparation, parent communication, payment disputes, and Platform policies.

Legal Requirements

Nothing in this Policy limits rights that cannot be waived under applicable law. Where required by law, Kidlinka will comply with applicable refund, payment, consumer protection, and financial rules.

Changes to This Policy

Kidlinka may update this Policy from time to time. Material changes may be communicated through the Platform or email. Continued use of the Platform after changes become effective constitutes acceptance of the updated Policy.

License Verification Policy

Introduction

This License Verification Policy explains how Kidlinka LLC reviews provider documents, issues verification status, manages the Verified Provider badge, and handles expired, incomplete, invalid, or fraudulent verification documents. Kidlinka operates a technology platform that connects parents and guardians with licensed childcare providers. Verification is intended to help improve trust and transparency on the Platform, but it does not replace a parent's responsibility to independently evaluate providers.

Purpose of Verification

Kidlinka's verification process is designed to help confirm that certain provider documents have been submitted and reviewed. Verification may help Kidlinka confirm provider identity; review childcare license information; review CPR certification; review First Aid certification; reduce fraud; support parent trust; improve Platform safety; support provider accountability; and maintain accurate provider listings.

Who Must Complete Verification

Providers must complete Kidlinka's verification process before receiving a Verified Provider badge. Kidlinka may require verification before a provider profile becomes publicly visible, receives enrollment inquiries, receives tour requests, participates in emergency childcare requests, or uses certain provider features.

Required Verification Documents

Providers may be required to submit:

  • Valid childcare license
  • Government-issued identification
  • CPR certification
  • First Aid certification
  • Business information
  • Facility information
  • Any other documentation reasonably requested by Kidlinka

Additional Documentation Requests

Kidlinka may request additional documentation when reasonably necessary to verify identity, ownership, licensing status, compliance, certifications, or Platform eligibility. Additional documents may include business licenses, facility records, ownership documents, regulatory or compliance records, proof of renewal, government records, identity verification documents, DCYF or licensing agency documents, incident-related documentation, and other reasonably requested materials.

Verification Review Process

Kidlinka may review submitted documents manually or through third-party tools, service providers, or automated systems. Kidlinka may compare provider documents against publicly available records, licensing records, business records, regulatory databases, internal records, or other sources. Kidlinka may approve, deny, delay, pause, or request additional information during the review process. Submitting documents does not guarantee approval.

Verified Provider Badge

A provider may receive a Verified Provider badge after Kidlinka reviews required verification documents. The badge may appear as a blue checkmark or similar symbol. A Verified Provider badge means only that Kidlinka reviewed certain submitted documents and determined that the provider met Kidlinka's verification requirements at the time of review.

What Verification Does Not Mean

A Verified Provider badge does not mean that Kidlinka conducted a criminal background check, home inspection, or safety inspection; guarantees provider quality, safety, or suitability; guarantees legal compliance or licensing status after verification; guarantees childcare outcomes; endorses or recommends a provider; or assumes responsibility for provider conduct. Parents remain responsible for independently evaluating providers before selecting childcare services.

No Background Check Representation

Unless expressly stated otherwise in writing, Kidlinka does not conduct criminal background checks on providers, provider employees, assistants, contractors, volunteers, or staff. Providers are responsible for complying with all background check, employee screening, and staffing requirements applicable to their childcare business.

Provider Responsibility for Accuracy

Providers are responsible for submitting truthful, accurate, current, complete, and authentic documents. Providers must not submit altered, expired, misleading, fake, fraudulent, incomplete, or unauthorized documents. Providers must promptly update Kidlinka if any submitted document changes, expires, is suspended, revoked, restricted, or otherwise becomes invalid.

Verification Expiration & Renewal

Verification status depends on the validity of required documents, including the childcare license, CPR certification, First Aid certification, business license (if required), and other verification documents. When a required document expires, Kidlinka may remove the Verified Provider badge, pause the provider account, hide the provider profile, suspend enrollment requests, suspend emergency childcare participation, restrict account functionality, or take other action.

Providers must submit updated documents before expiration. Verification may be restored after updated documentation is submitted, reviewed, and approved. Kidlinka is not required to restore verification until it is satisfied the provider meets all verification requirements.

Verification Renewal Reminders

Kidlinka may send reminders before required documents expire — approximately twenty-one (21) days, fourteen (14) days, seven (7) days, and on the expiration date, and after expiration. Providers remain solely responsible for maintaining valid documents whether or not reminders are received. Failure to receive a reminder does not excuse a provider from maintaining valid licenses, certifications, insurance coverage, or required documentation.

Failure to Verify & Expired Documents

If Kidlinka is unable to verify a provider's documents, Kidlinka may pause the account, remove or withhold the Verified Provider badge, hide the profile from public search results, suspend enrollment requests and emergency childcare participation, restrict account functionality, request additional documentation, or deny provider participation. The account may remain paused until sufficient documentation is received.

If a provider's required document expires, Kidlinka may immediately pause the account or restrict Platform features, resulting in removal of the badge, profile visibility restrictions, suspension of enrollment leads and emergency childcare requests, suspension of payouts where appropriate, account restrictions, suspension, or termination.

Regulatory Investigations & License Actions

Providers must notify Kidlinka immediately if they become aware of a regulatory investigation, licensing investigation, agency action, suspension, revocation, restriction, probation, compliance issue, or other concern involving their childcare license or operations. If Kidlinka becomes aware of such concerns, it may remove the Verified Provider badge, pause listings, hide the provider profile, suspend enrollment requests and emergency childcare participation, restrict account functionality, request additional documents, suspend payouts where appropriate, remove the provider from the Platform, or take other action necessary to protect users, children, parents, providers, and the Platform.

Fraudulent or Altered Documents & Enforcement

Providers may not submit fake, altered, misleading, expired, stolen, unauthorized, or fraudulent documents — including fake or altered childcare licenses, fake CPR or First Aid certifications, false government identification, identity fraud, misleading ownership documents, misrepresented business records, or any other false verification information.

If Kidlinka discovers or reasonably suspects fraudulent, altered, misleading, or unauthorized documentation, it may immediately remove verification status, immediately suspend the provider account, permanently remove the provider from the Platform, withhold payouts where permitted, cancel pending requests, notify affected users where appropriate, and report suspected fraud to licensing agencies, regulatory authorities, law enforcement, payment processors, or other appropriate entities where legally permitted or required.

Verification Denial & Reapplication

Kidlinka may deny verification if required documents are missing, cannot be verified, appear altered or fraudulent, or if information does not match public records; if the provider fails to respond to requests; if licensing, insurance, or identity cannot be confirmed; if safety or compliance concerns exist; if the provider violates Kidlinka policies; or if Kidlinka determines verification is otherwise not appropriate.

A provider denied verification may be allowed to submit updated or corrected documents. Kidlinka may decide whether to allow reapplication. Kidlinka is not required to approve a provider simply because new documents are submitted.

Public Display of Verification Status & License Information

Kidlinka may display verification status on provider profiles, including Verified Provider badge, Not Verified status, Pending review status, Expired or Suspended verification status, or other status indicators. Kidlinka may change verification status at any time based on updated information, expired documents, compliance concerns, or Platform policies.

Kidlinka may also publicly display certain provider information, including license number, status, licensed capacity, ages accepted, hours of operation, program type, languages spoken, verification status, and other profile information submitted by the provider or available through public records.

Parent Responsibility

Parents are responsible for evaluating providers before selecting childcare services. Parents are encouraged to review provider profiles and license information, review ratings and reviews, ask questions, request tours, verify information independently where appropriate, and determine whether a provider is suitable for their family. Kidlinka does not make childcare decisions for parents.

Provider Duty to Update Information

Providers must promptly update Kidlinka when there are changes to license status or expiration, insurance coverage, CPR and First Aid certifications, business address, ownership, capacity, program type, hours of operation, age groups served, regulatory status, safety or compliance concerns, or any other information relevant to verification.

Third-Party Information & Verification Limitations

Kidlinka may rely on third-party records, public databases, provider-submitted materials, licensing agency information, regulatory sources, and other available information during verification. Kidlinka does not guarantee that third-party information is complete, current, accurate, or error-free. Verification is limited by the information available to Kidlinka at the time of review. Documents may later expire, become invalid, be suspended, or become inaccurate. Kidlinka does not continuously monitor all providers in real time unless expressly stated.

Changes to Verification Requirements

Kidlinka may change verification requirements at any time due to Platform safety needs, fraud prevention, insurance or regulatory requirements, expansion into new states, payment processor requirements, business needs, changes in childcare laws, or user safety concerns. Providers may be required to submit additional documents after requirements change. Kidlinka may also introduce automated verification tools in the future.

No Waiver of Rights

Kidlinka's decision to approve a provider, issue verification, delay action, or allow continued access does not waive Kidlinka's right to later remove verification, restrict access, suspend accounts, request additional documents, or take enforcement action.

Changes to This Policy

Kidlinka may update this Policy from time to time. Material changes may be communicated through the Platform, email, or other reasonable means. Continued use of the Platform after changes become effective constitutes acceptance of the updated Policy.

Community Guidelines

Introduction

Kidlinka LLC is committed to creating a safe, respectful, trustworthy, and professional environment for parents, guardians, childcare providers, and all Platform users. These Community Guidelines apply to all users of the Kidlinka Platform, including parents, guardians, childcare providers, employees, staff members, and any individual using Kidlinka services. By using Kidlinka, you agree to follow these Community Guidelines.

Child Safety First

Child safety is the highest priority on the Platform. Users must not endanger, abuse, neglect, exploit, or harass children; share inappropriate content involving children; misrepresent information about children; or violate childcare safety requirements. Kidlinka may immediately suspend or terminate accounts involving child safety concerns.

Respectful Communication

Users must communicate respectfully at all times. Users may not harass, threaten, or intimidate others; use abusive, discriminatory, or hateful language; bully others; or engage in personal attacks. Parents and providers are expected to communicate professionally and respectfully in all Platform interactions.

Honest Information

Users must provide accurate and truthful information at all times. This includes parent identity information, child information, emergency request information, provider licensing and business information, payment information, and profile information. Providing false information may result in suspension or removal from the Platform.

Emergency Childcare Requests

Emergency childcare requests must be genuine. Users may not submit fake or misleading requests, abuse emergency childcare services, repeatedly submit requests without intent to use care, or use emergency requests to harass providers. Emergency requests may be shared with multiple nearby providers; the first qualified provider to accept may receive the booking opportunity.

Identity Verification

Parents and guardians should provide accurate identification information. For emergency childcare services, providers may request government-issued identification during drop-off or pick-up. If identification does not reasonably match booking information, providers may refuse service and notify Kidlinka.

Provider Conduct

Providers must maintain required licenses, certifications, and insurance; provide truthful information; maintain safe childcare environments; treat families respectfully; and follow all applicable laws and regulations. Providers may not misrepresent services, certifications, availability, or qualifications.

Parent Conduct

Parents must provide accurate child information and emergency contact information, respect provider policies, communicate honestly, arrive on time when possible, and follow applicable Platform rules. Parents may not intentionally misrepresent child needs, ages, medical information, allergies, or emergency circumstances.

Reviews & Ratings

Reviews should reflect genuine experiences. Users may not post fake or misleading reviews, exchange compensation for reviews, threaten users through reviews, or use reviews to harass others. Providers may request review investigations if they believe a review violates Platform policies. Kidlinka may investigate and remove reviews when appropriate.

Fraud & Misrepresentation

Fraud is strictly prohibited. This includes fake licenses, certifications, or insurance documents; identity fraud; payment fraud; chargeback abuse; fake reviews; false advertising; and misrepresentation of services. Kidlinka may immediately suspend or permanently remove users involved in fraud.

Privacy & Confidentiality

Users must respect the privacy of others. Users may not share personal information without permission, sell personal information, disclose confidential information, collect information for unauthorized purposes, or use Platform information outside intended childcare-related purposes. Kidlinka does not sell personal information.

Child Photos & Media

Providers may upload child photos only when they have appropriate parental or legal guardian consent. Users may not upload content that violates privacy rights or applicable laws. Kidlinka may remove content that violates privacy or safety standards.

Discrimination & Harassment

Discrimination, harassment, or hateful conduct is prohibited. Users may not harass or discriminate against others based on protected characteristics under applicable law. Violations may result in account suspension or termination.

Platform Fees & Off-Platform Transactions

Providers may not intentionally use Kidlinka to obtain families and then move transactions off-platform for the purpose of avoiding Platform fees. Attempts to circumvent Platform fees may result in warnings, account restrictions, suspension, or termination.

Emergency Request Reliability

Providers participating in emergency childcare services should accept requests only when reasonably able to provide care. Repeated cancellations after acceptance may result in warnings, removal from emergency childcare participation, suspension, or termination.

Social Media & Marketing Content

Users may not upload false advertising, misleading content, infringing content, defamatory content, or illegal content. Providers remain responsible for marketing content published through Platform tools.

Reporting Violations

Users are encouraged to report suspected violations, including child safety concerns, fraud, fake reviews, harassment, licensing concerns, privacy violations, payment abuse, and other violations. Kidlinka may investigate reports and request supporting information.

Enforcement

Kidlinka may take action when Community Guidelines are violated. Actions may include warnings, content removal, review removal, verification removal, account restrictions, feature restrictions, suspension, or permanent account termination. Kidlinka may act with or without prior notice when necessary to protect users, children, or the Platform.

Reporting to Authorities

When appropriate or required by law, Kidlinka may report suspected fraud, child safety concerns, criminal conduct, licensing concerns, or other serious matters to law enforcement, regulatory agencies, licensing agencies, or other appropriate authorities.

Changes to These Guidelines

Kidlinka may update these Community Guidelines from time to time. Continued use of the Platform after updated Guidelines become effective constitutes acceptance of the revised Guidelines.
